The U.S. Department of State, through the Directorate of Defense Trade Controls (DDTC) administers the International Traffic in Arms Regulations (22 CFR §§120-130), or “ITAR.” These regulations cover items and information that are inherently military in design, purpose, or use. Referred to as “defense articles,” these items are found on the U.S. Munitions List (USML). Defense articles include technical data recorded or stored in physical form, models, mockups, and other items that reveal technical data directly relating to USML items. The US Department of Commerce enforces the Export Administration Regulations (EAR) through the Bureau of Industry and Security (BIS). The EAR broadly governs and imposes controls on the export and re-export of most commercial goods, software, and technology, including 'dual-use' items that can be used both for commercial and military purposes and certain defense items.
